August 14, 2013 Meeting

Executive Session

 

Prior to the start of the Executive Session, homeowner Elio Arce handed out a letter to the board and spoke to the board.

 

DeRousse left the meeting at 8:06 pm

 

Curry left the meeting at 8:07 pm.

 

The executive session began at 8:08 pm.

 

Deed Restriction Violations to Legal

 

There was a discussion of the 13 addresses Grothues emailed to the board on August 12th. Grothues recommended that these homeowners be sent certified letters for outstanding deed restriction violations.

 

Based on Grothues’ notes, Du Bois questioned whether or not there was a picture of 56XX Arncliffe. Grothues noted that she checked and the stump is actually about one half of a tree and noted that it needed to be removed because it was dead. The yard also has bare spots.

 

Grothues discussed her note re: 75XX Deep Forest. She noted that she was not able to see the chimney the day she drove by due to the sun, but the picture Pierce provided clearly shows that the chimney has quite a bit of mildew growing on it

 

Grothues discussed 59XX Green Terrace and noted that the pool has been reported to the City of Houston twice. Grothues recommended that this address remain on the list.

 

Grothues discussed 59XX Darkwood. She noted that the homeowners were running a full service garage from their home on weekends. Grothues contacted a resident to check on the current activity. She was told that the activity has decreased to about one weekend a month. Grothues questioned if the board should put a hold on this for the time being. Martin noted that she would recommend sending a certified letter in the hopes that all activity would cease.

 

Pierce stated that 74XX Antoine Dr. sent in pictures late today showing that they have put down sod grass to fill in bare spots in the yard. Grothues said that she had seen the email and pictures and that this address should be removed from the list.

 

Martin moved to approve sending certified demand letters to 19 of the 20 addresses in Grothues’ email to the board dated August 12th, excluding 74XX Antoine . Du Bois seconded the motion. Du Bois, Haynes, Hodge and Martin voted in favor. The motion carried.

 

 

Collections

 

Martin moved to proceed with sending certified demand collection letters to the 13 accounts listed in her email to the board dated August 10th. Du Bois seconded the motion. Du Bois, Hodge, Haynes and Martin voted in favor. The amended motion carried.

 

Martin left the meeting at 8:17 pm.

 

55xx Arncliffe- Update

 

Grothues reported that no construction work has been done on this lot since the last monthly meeting and nothing has appeared on the weekly permit list the city sends out via email during that same time period. Grothues reminded the board that the city issued a cease and desist order several months ago and all work has stopped since then. Grothues stated that if new plans are not submitted soon, IFCIA will need to consider sending a letter to the owners to clean up the construction site.

 

76xx Antoine- Update

 

The Board discussed the residency issues related to this home. Grothues reported that there has been correspondence with the homeowner. A letter has been sent requesting that the homeowner and their legal counsel, if any, meet with IFCIA and our legal counsel to discuss this issue. The board has not receive a reply to the request to date.

 

Grothues noted that this home does not fall under the city’s new group home regulations, because he says he is running a facility covered by the ADA, which does not require him to be licensed.

 

 

56xx Cone Crest

 

Grothues informed the Board that the owners have now painted the brick on both sides of the house, in addition to the front. HS has drafted a petition asking the owners to take down or get approval for new materials for the shed, get approval for materials used for siding on the garage and remove paint from the tree at the side of the house. The board will not ask them to remove paint from the brick because it could possibly damage the brick. Grothues noted that the petition draft needed to be revised to delete the part about the painted brick and add that they need to repair rotten wood on a front window.

 

80xx Green Lawn

 

Correspondence has been sent to the homeowner regarding what appears to be used car business being run from their home. Several cars in the driveway have “for sale” or “sold” written on the windows. The cars also have temporary license tags. Two letters have been sent to the homeowner to date.

Adjournment

 

With no further business to come before the Board in Executive Session, the meeting was formally adjourned to General Session at 8:52 pm.
