Executive Session
The executive session began at 8:18 pm.
59XX Bent Bough – Update
Grothues noted that the house was recently sold and that the side fence has not been moved within the 10 ft set back nor was IFCIA contacted by the new owner prior to the purchase regarding a new agreement. HS has been asked to follow up on this.
Fence Violation – 72XX Tall Pines
Grothues informed the Board that the owners were at the town hall meeting for border lot owners on December 4th . After the meeting, they asked if, as an alternative, their fence could be tapered from 7 ft down to 4 ft. Grothues asked the homeowners to contact the board with a proposal to do this and emailed them contact information for the board.
Collections to Legal
No accounts were recommended to legal for December.
Deed Restrictions to Legal
No lots were recommended to legal for December.
76xx Antoine – Update
There was no new information regarding this.
Section 20
Grothues noted that HS is drafting a document and that it will be circulated to the Board once HS has completed it.
Section 12
Grothues informed the Board that HS has reviewed the Section 12 petition to modify the deed restrictions regarding fencing. HS noted that the record owners of a majority of the lots need to have signed the petition. There was also a discussion regarding the number of owners that need to sign if the lot is owned by more than one person.HS noted that to properly determine the number of lot owners, the deed filed for each property would need to be pulled.
Grothues also noted two other items:
- the petition refers to lots that back up to W. Bank Rd. The correct name of the street is W. Gulf Bank.
- Grothues also noted that per a review of the petition, there were more than 30 lots in Section 12 that could have up to 8 ft fences, per the original deed restrictions, and can no longer have them if the petition filed is valid.
