Executive Session

 

The executive session began at 7:44 pm.

 

 

59XX Bent Bough – Update

 

As noted in December, this house was recently sold and that the side fence has not been moved within the 10 ft set back nor was IFCIA contacted by the new owner prior to the purchase regarding a new agreement. Jeremy Baker at HS has spoken to the new owner.

 

 

Fence Violation – 72XX Tall Pines

 

Grothues noted that the homeowner has not submitted an ACC to date regarding reducing the height of their fence.

 

 

Deed Restrictions to Legal

 

Martin moved to send the 10 lots per Grothues’ January 8th email to the board to legal with the exception of 55xx Black Jack. Cornett, Du Bois, Haynes, Hodge and Martin voted in favor. Curry abstained. Motion carried.

 

76xx Antoine – Update

 

There was no new information regarding this.

 

Section 20

 

Grothues noted that HS has finished the draft of the petition and that it needs to be reviewed. It will be circulated to the board once it has been reviewed.

 

 

Section 12

 

Grothues noted that the review of the signatures has been completed and it appears that the signatures for some lots lack the signatures of all record owners. The total number lots in question exceeds 20. HS has previously noted that the only way to verify the record owners of the lots in Section 12 is to pull the warranty deeds for those properties. The question now is does the Board want to move forward with pulling the warranty deeds for the lots in question.

 

Curry moved to table this issue until a new board comes in. ( Note: the annual meeting is scheduled for January 23, 2014.) Du Bois seconded. Cornett, Curry, Du Bois, Haynes and Martin voted in favor. Hodge abstained and noted that a new board will not change the legality of the signatures. Motion carried.

 

Outstanding ACC Requests

 

  1. 60xx Black Maple – car port – Martin moved to deny the homeowners ACC request dated December 9, 2013 for the carport that was added in 2013. Du Bois seconded. Cornett, Curry, Du Bois, Haynes, Hodge and Martin voted in favor. Motion carried.

 

  1. 55xx Black Jack – expansion of driveway – the Board discussed and agreed that one more letter should be written to the homeowners asking them to redo the original driveway plus the first expansion and have a professional repour the entire thing so that the look of the driveway is uniform. Grothues went around the table and all board members were in agreement.

 

  1. 59xx Green Falls – Hodge moved to table this request for a 6 ft wood fence along the rear property line pending the Board’s decision regarding the Section 12 petition above and the verification of the signatures needed for 20+ lots. Du Bois seconded. Cornett, Curry, Du Bois, Hodge & Martin voted in favor. Haynes opposed. Motion carried.

With no further business to come before the Board in Executive Session, the meeting was formally adjourned to General Session at 8:31 pm.
