November 13, 2013 Meeting

Executive Session

 

The executive session began at 8:18 pm.

 

Meeting Requested by Owner of 76XX Streamside

 

The resident was not present for the requested meeting.

 

Meeting Requested by Owner of 59XX Donwhite

 

The resident emailed Genesis stating that he would not be able to attend the requested meeting but had set up a scheduled roof cleaning. Resident informed that he would advise Genesis after the cleaning so that the roof could be inspected.

 

Fence Violation – 72XX Tall Pines

 

Du Bois motioned to deny the 7ft along the sides of the property remain, as it does not adhere to the deed restrictions for their sections. Martin seconded the motion. Curry opposed. Cornett abstained. The motioned was passed. Genesis will send out letter notifying resident to remove the fence immediately in order to avoid further violation.

 

 

Deed Restriction Violations to Legal

 

There was a discussion of the 15 addresses Grothues emailed to the board on November 11th. Grothues recommended that these homeowners be sent certified demand letters (CDL’s) for outstanding deed restriction violations.

 

Curry asked that those homeowners with grass in bare spots violations not be mailed certified demand letters. Curry stated that due to the current cold weather conditions it would be highly difficult for those homeowners to allow new grass to grow. Grothues noted that the homeowners have been sent three letters each month starting in July and have had ample time to cure the violation or call into Genesis stating when they can cure the violation.

 

Martin moved to approve sending CDL’s to 13 of the 15 accounts listed in Grothues’ email to the board dated November 11th, with the exceptions being 59XX Donwhite which will be inspected after the scheduled roof cleaning and determined then whether or not to send a certified demand letter and also 72XX Tall Pines Dr. which will receive a letter notifying them of the Board’s decision to have them remove the fence within 30 days, if the fence is not removed within the time frame given a certified demand letter will be sent. Du Bois seconded the motion. Du Bois, Hodge and Martin voted in favor. Curry was opposed. The motion carried.

 

 

Collections to Legal

 

Martin moved to proceed with sending CDL’s for outstanding balances to the 6 accounts listed in her November 11th email to the Board. Du Bois seconded the motion. All voted in favor. The motion carried.

 

76xx Antoine- Update

 

The Board discussed the residency issues related to this home. Grothues reported that after speaking with HS it was suggested that the Association take a different approach to dealing with this issue and Section 20. That recommendation is noted in the email drafted by HS and forwarded to the board. Cornett further informed the Board that the home has seen an abundance of police activity within the past week. Grothues stated that she would check with HPD to see what information she could obtain as to why the home recently has had so many police visits.

 

 

80xx Green Lawn – Update

 

Grothues informed the Board that the owners have refused to sign the drafted agreement. She noted that the owners stated they did not want to limit the number of cars in their driveway or home. Grothues suggested that the home be monitored for now as currently the car count has been fewer than 4 vehicles at a time. The Board agreed.

 

Section 20

 

Grothues noted that in order for the violation to be corrected with 76XX Antoine the Association needed to write deed restrictions for section 20, as suggested by HS. Grothues noted that 3 owners have signed and all others that have not signed will be included in the lawsuit.

 

Martin moved to have HS start the legal action process against all homeowners in section 20 that have not signed the agreement. Du Bois seconded. Curry opposed. Motion passed.

 

Section 12

 

Grothues noted that due to the petition that was signed by majority of the homeowners in section 12 noting that they wanted a fence around their property. Grothues suggested that the Board schedule a town meeting for all homeowners in sections that are not allowed a fence. Grothues stated that this would help gain a consensus on not only who wants a fence in the community but also the type of fence. Grothues stated that it would help with maintaining uniformity around the entire community. Cornett questioned the date of the event and whether or not it would be best to schedule it sometime in January. Grothues stated that due to the petition it would be best to start gaining the opinion of homeowners as quickly as possible, but did note that if majority of homeowners didn’t show that another town hall meeting would be scheduled. The Board agreed.

With no further business to come before the Board in Executive Session, the meeting was formally adjourned to General Session at 9:29 pm.
